Please read these terms carefully before using our services
Please read these terms of service (the "Terms") carefully before using the ClickTrails web application and any related services (collectively, the "Service"). Your use of this Service is conditional on your acceptance of these Terms. By visiting or using this Service, you agree on your own behalf, and on behalf of any organization on whose behalf you may act (collectively referred to herein as "you"), to accept and abide by these Terms for each use of and visit to this Service. You also consent to and agree to comply with our Privacy Policy, available at https://clicktrails.vercel.app/privacy.
These Terms govern your access to and use of the Service. These Terms limit the liability of ClickTrails, a project operated by its creators ("ClickTrails," "we," or "us"), and include other important provisions that affect your rights and obligations.
ClickTrails grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable, royalty-free license to use and access the Service for your own internal development and testing purposes. Use of the Service must comply with these Terms and any applicable laws.
We may modify, expand, restrict, suspend, or discontinue the Service at any time and for any reason, with or without notice. Your use of the Service does not guarantee ongoing availability of any specific functionality.
You may be required to register and create an account to use certain features of the Service. You agree to keep your login credentials confidential and not to share them with any other person. You are solely responsible for all activity occurring under your account.
You agree to:
You must not:
All right, title, and interest in and to the Service and all underlying technology, software, content, and documentation are owned by ClickTrails or its licensors. Except as expressly permitted by these Terms, you may not copy, modify, distribute, or create derivative works based on any part of the Service.
ClickTrails reserves all rights not expressly granted in these Terms.
The Service is provided "as is" and "as available," without warranties or conditions of any kind. ClickTrails disclaims all warranties, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement.
ClickTrails does not guarantee that the Service will be secure, error-free, or available at all times. You use the Service at your own risk.
To the fullest extent permitted by law, ClickTrails and its developers, contributors, and agents shall not be liable for any damages arising out of or relating to your use of the Service, including but not limited to direct, indirect, incidental, consequential, special, or exemplary damages—even if advised of the possibility of such damages.
You agree to indemnify and hold harmless ClickTrails and its creators from and against any claims, losses, liabilities, damages, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
ClickTrails may terminate or suspend your access to the Service at any time, with or without notice, if you breach these Terms or for any other reason at our sole discretion.
You may terminate your account at any time by ceasing use of the Service. Upon termination, all rights granted to you under these Terms will immediately cease.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflicts of law principles.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
These Terms constitute the entire agreement between you and ClickTrails regarding the use of the Service, and supersede all prior or contemporaneous agreements or understandings, whether written or oral.
ClickTrails may assign these Terms without notice or consent. You may not assign or transfer these Terms.
